Measures for the Administration of the Participation of Non-mainland Chinese and Foreigners in Professional Qualification Examination in Hainan Free Trade Port (Trial Version)  

Chapter 1 General Provisions 

Article 1 The Measures is formulated based on the Overall Plan for the Construction of Hainan Free Trade Port, relevant provisions regarding professional qualification exams in China, and the status quo of Hainan with a view to meeting the demands of comprehensively deepening reform and opening up in the province, and encouraging and attracting foreigners to work and start business in Hainan FTP. 

Article 2 The Measures is applicable for non-mainland Chinese and foreigners who take part in related professional qualification exams in Hainan FTP. 

Article 3 Checklist administration is adopted regarding the items related to non-mainland Chinese and foreigners sitting for professional qualification exams in Hainan FTP. The checklist is jointly published by competent talent administration of the CPC Hainan Provincial Committee, provincial department of human resources and social security as well as provincial industry regulatory agencies, and subject to adjustment in light of the needs of the construction of Hainan FTP. And new state regulations (if any) shall prevail. 

Article 4 Non-mainland Chinese and foreigners who participate in professional qualification exams held in Hainan FTP are subject to the same exam criteria, organization and certificates as Chinese are. 

Chapter 2 Registration and Exam 

Article 5 Non-mainland Chinese and foreigners that abide by Chinese laws and regulations as well as professional ethics, and meet the national or provincial requirements of professional qualification exams (unless there are nationality-related restrictions) may sign up and sit for professional qualification exams matching their professions and levels on a voluntary basis. Their working experience abroad shall be accepted as domestic one. 

Specific conditions of each professional qualification exam shall be released by competent provincial industry administrations or corresponding exam providers. 

Article 6 When registering for any professional qualification exams, non-mainland Chinese and foreigners shall fill out the Registration (Approval) Form for Professional Qualification Examination, and submit to the competent provincial industry administration or corresponding exam provider a scanned copy of their valid identity document (For non-mainland Chinese: the Mainland Travel Permit for Hong Kong and Macao Residents, Mainland Travel Permit for Taiwan Residents, or Residence Permit for Residents from Hong Kong, Macao and Taiwan; For foreigners: valid passport & entry visa or Foreign Permanent Resident ID Card) together with proof of their working years and other related materials. 

Article 7 The competent provincial industry administration or corresponding exam provider shall carry out qualification check of the entrants, and grant those that pass the check an admission ticket. The entrants shall sit for the exam in the set venue at set time as per the admission ticket. 

Article 8 When the competent provincial industry administration or corresponding exam provider make announcements or notices of the professional qualification exam, it shall be explicit about the participation of non-mainland Chinese and foreigners in the exam, such as the deadline for registration; on-mainland Chinese and foreigners, when sitting for the exam, shall bring valid identity documents (same as those used for registration and admission tickets), and use designated stationery to take the exam as required. 

Article 9 Non-mainland Chinese and foreigners shall follow the rules and regulations when sitting for a professional qualification exam. In case of any violations, violators shall be dealt with as stipulated by national or provincial penalties of violations in professional qualification exams. 

Chapter 3 Certificates and Entitlements 

Article 10 In case non-mainland Chinese and foreigners pass the exam, competent provincial industry administrations or corresponding exam providers shall proceed with verification and issuance of the certificate as regulated, and report such certificate holders to the Talent Development Bureau of CPC Hainan Provincial Committee for filing.  

Article 10 The certificate non-mainland Chinese and foreigners get after passing a professional qualification exam in Hainan FTP certifies that he/she is eligible for the profession in question with adequate command of knowledge and expertise, and is therefore recognized within Hainan FTP (as for national professional qualification exams that have been opened to non-mainland Chinese and foreigners, corresponding certificates are recognized nationwide.) 

Chapter 4 Supplements 

Article 12 The rate of professional qualification exams for non-mainland Chinese and foreigners shall be defined in accordance with related national or provincial regulations. 

Article 13 The Talent Development Bureau of CPC Hainan Provincial Committee, Hainan Department of Human Resources and Social Security and competent provincial industry administrations reserve the joint right to interpretation of the Measures. 

Article 14 The Measures shall be effective upon issuance.
